– Ensure that there are backup decision-makers (fiduciaries) listed in the estate plan for key roles such as Personal Representative, Trustee, and Power of Attorney/Agent.
– Consider the possibility that the designated individuals may no longer be able or willing to fulfill their roles, and have backups in place.
– Regularly review and update the estate plan to reflect any changes in the circumstances of the designated decision-makers, such as changes in their age or legal status. – Regularly reevaluate choice of trusted decision-makers for estate planning documents and name backups if necessary
– Ensure alternatives are in place to avoid chain of command failures that lead to court involvement in end-of-life matters
