Redefining Quasi-judicial: The Diminishing Role of Quasi-judicial Determinations in Local Government Personnel Actions

A corrections officer in Miami-Dade County was disciplined for having a relationship with a former inmate. She appealed her punishment through the county’s process, but then filed a lawsuit in a different court. The appeals court said she couldn’t do that because she already used the county’s process. They said she had to appeal within the county’s system instead of going to a different court. This long and complicated legal article discusses how a court’s review process for disciplinary actions taken against government employees has changed over time in Florida. It explains that the process used to be very specific, but has become more lenient in recent years, making it easier for employees to challenge their disciplinary actions in court. The court in Barad said that if an employee goes through the review process in an ordinance, they can’t ask for a new hearing in court. But this is wrong. Just because there’s a process in the ordinance doesn’t mean it’s fair. The court needs to go back to the Barad decision and only say there can’t be a new hearing if the employee went through the whole process and it was fair. It would be even better to make all government entities follow the Florida APA rules. This would make sure that the process is fair for everyone. This article discusses a court case between Miami-Dade County and Moreland. The case involves a zoning issue, and the court is reviewing the decision made by the lower court.
