But then, the court removed Matthew from Brad’s care without giving him a chance to say goodbye. Now, Matthew is living with a relative he barely knows. A man named Brad tried to find a lawyer to help a little boy named Matthew get back with his family. But the court said no, and now Matthew is far from home with no way to speak up for himself. Florida isn’t doing a good job of making sure foster kids have lawyers to help them. Even though people have been trying to change the law, kids in Florida still don’t have the right to a lawyer in court. The current system for providing legal representation to children in state care is not working well. The program that is supposed to represent these children only covers 70% of them, and even when they are represented, their legal interests might not always be taken care of. Some people argue that the court can appoint an attorney for the child if needed, so there’s no need for a law that guarantees representation. However, this doesn’t always happen, and many children still don’t get the legal help they need. Children in state care often do not know that they have the right to ask for a lawyer. Even if they do, it can be difficult to communicate their needs in court. One solution is to allow a trusted adult to step in and ask for a lawyer on the child’s behalf. This is already allowed in other types of court cases, and it would give a voice to children who may not be able to speak up for themselves. In Florida law, the term guardian ad litem can mean different things. In dependency court, a guardian ad litem represents the best interests of a child in a case. They are considered a party in the case and can file motions on behalf of the child. If there is no guardian ad litem, another well-informed adult can help the child ask the court for a lawyer. This gives children a voice in court. A next friend in a civil case is someone who appears in court for someone who can’t, like a kid or someone who can’t make their own decisions. They are a responsible person who fights for the rights of the person they’re representing. In the dependency court, a next friend could be anyone who knows the child well and is willing to ask for a lawyer to represent the child in court. Their role ends when a lawyer is appointed, unless they need to appeal the decision. In short, the dependency next friend helps someone who isn’t a party in the case to get their voice heard in court. If a child in the foster care system needs a lawyer, a next friend can help them ask the court for one. The next friend is not responsible for paying the lawyer, and the lawyer will not be directed by the next friend in how to represent the child. The next friend’s job is just to help the child ask for a lawyer, and once the lawyer is appointed, the next friend’s role is finished. The rules for lawyers in Florida say that even if a client is young or has a disability, the lawyer should still treat them with respect and make decisions with their best interests in mind. Sometimes, someone other than the client, like a grandparent or foster parent, might try to get a lawyer for the client for their own reasons. But the rules for lawyers are clear about conflicts of interest, and the lawyer should always do whatâs best for the client. If anyone thinks a lawyer has a conflict of interest, they can ask the court to disqualify the lawyer. But lawyers who help children in state care should be treated the same as any other lawyer. Florida needs to make sure that every child in state care has a lawyer to help them. Right now, many kids don’t have a lawyer to speak for them in court.
