Unless the Court orders differently, your support obligation will continue to accumulate even if you are unable to make the payments. This is money that you will still be required to pay to the other party at a later point in time. If the Court determines that your inability to pay the support was due to circumstances beyond your control, it will calculate the amount you owe and could increase future support payments to cover the outstanding balance. However, if the Court finds that you had the means to pay the support but chose not to, you may be held in contempt of court. Along with repaying the overdue amount, you could be subject to various sanctions, including the payment of the other party’s legal expenses.
