A company (referred to as Registrant) or the legal representative (referred to as authorized representative) can submit H-1B Registrations with the USCIS.

Step 1: Create an account.
Access the website my.USCIS.gov, click on “Create an Account,” and complete the registration process according to the on-screen instructions.
Step 2: Select your preferred method for receiving the verification code and enter it upon receipt.
Step 3: If you have legal representation ? refrain from selecting “File a Registration.” Your legal counsel will handle the registration process and provide you with an approval passcode for review. Insert the passcode in the designated field that states, “Received a passcode from your Attorney or Representative.” Proceed with reviewing and approving the Registration. Confirm your consent to the G-28 and H-1B Registrant forms by entering the authorized signatory details on behalf of the employer. If you do not have legal representation, select “File Registration” and adhere to the instructions on the screen.
Step 4: Complete the $10 payment via pay.gov and submit the H-1B Registration to the USCIS.

After the registration is completed, the company will have to wait to hear from the immigration office to see whether the company’s potential employees have been selected through the Lottery.
If Selected, the company may submit the completed H-1B application to the immigration office to complete the H-1B Process.
If Not Selected: at the end of the fiscal year, (usually runs from October 1st of the previous year to September 30th of the current year) the immigration office adds “Not selected” to employees who are not selected within that fiscal year, on the official website.

Obtaining a Certified Labor Condition Application (“LCA”) from the Department of Labor which establishes the conditions of the employment.
Once LCA is certified, file complete Form I-129 and file the petition with USCIS
Potential H-1B worker, if outside of the US, attends the visa interview at the consulate to obtain the H-1B visa stamp.
Potential H-1B workers if already inside the US and that was indicated in the I-129 petition, the worker can begin work for the employer as described in the petition.
