What defines a habitable (tenantable) state?


An accommodation is considered NOT habitable if it significantly lacks any of the following: ? Ceiling, partitions, and windows that do not leak ? Functional plumbing or gas facilities
? Water supply with connected hot and cold running water to a sewage disposal system
? Operational heating system
? Functional electrical lighting and wiring
? Clean and sanitary building and grounds free from garbage, rodents, and vermin
? Sufficient number of well-maintained garbage cans or dumpsters
? Floors, stairways, and railings in good condition
Additional standards may be established by state and/or local city codes. Merely the presence of one of these conditions does not automatically deem a unit uninhabitable. The court will evaluate if it substantially lacks these conditions.
