What is considered as a Toxic Workplace Environment?
If you are overlooked for a promotion that you believe you deserve due to the results you have achieved, and you suspect it is because of your gender, you may have grounds to pursue a claim for workplace discrimination. However, if your boss directs lewd, offensive, or derogatory remarks towards you, you may have grounds to pursue a claim for workplace harassment.
This also applies to instances of ethnic slurs or racist jokes: this constitutes workplace harassment based on national origin or race.
Anti-discrimination laws are not designed to enforce civility in the workplace. These laws do not prohibit minor teasing, casual remarks, or occasional incidents that are not significant in nature. Instead, the behavior must be sufficiently severe or pervasive to alter the individual’s working conditions, either through a tangible employment consequence or by creating an objectively offensive and hostile work environment.
Toxic work environment harassment refers to an unstable or dangerous workplace created when an employee suffers repeated workplace harassment. The harassing conduct unreasonably interferes with the victim’s work performance or creates what a reasonable person would find an objectively hostile or offensive work environment. If the conduct adversely affects the performance or well-being of the targeted employee, or any reasonable person in the workplace, the conduct may be illegal.
