Typically, the participants initially gather as a group, and the mediator explains the forthcoming events and the ground rules. The participants sign a confidentiality agreement. If necessary, each participant presents a brief statement of the conflict. The participants will either remain in the same room while exploring options or the mediator will separate them into different rooms, depending on the mediator’s decision on which process encourages resolution better. The mediator may hold individual meetings known as “caucuses” with each party. The order in which the mediator meets with the parties or the duration spent with each party should not be construed as significant?it does not imply a bias towards any side. An effective mediator remains impartial and aids both parties in achieving a resolution to their dispute. Once an agreement is reached by the parties, they will collaboratively draft a legally binding settlement agreement.
