When parents are not divorced yet, can one parent move with the children out of the state?


If a divorce case has been initiated in the state and one parent wants to relocate outside its jurisdiction, that parent must adhere to the provisions of the relocation law and submit a written request to the other parent for permission to relocate. If the other parent consents to the relocation, then the parent may proceed with the move. However, if the other parent objects to the relocation, the parent seeking to relocate must then file a petition for relocation seeking approval to move out of the state.
